1. Description of the Service

You are responsible for ensuring that your use of the Service is permitted under the laws, platform rules, and age requirements applicable to you.

All rights, title, and interest in and to the Service, including games, software, artwork, characters, logos, names, designs, user interface, text, audio, visual content, gameplay elements, and other materials, are owned by Game Shelter or its licensors.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, sell, license, reverse engineer, or otherwise exploit any part of the Service unless we give you explicit written permission.

All trademarks, logos, and service marks displayed in the Service are the property of their respective owners.

5. In-App Purchases

Some of our games may offer in-app purchases, subscriptions, virtual items, virtual currency, boosters, hints, lives, energy, ad-free options, or other paid digital features.

All purchases are processed by the applicable platform provider, such as Apple App Store, Google Play, or another app store or payment provider. We do not directly collect or store your full payment card details.

Purchases are subject to the terms, conditions, and refund policies of the applicable platform provider.

Except where required by applicable law or platform policy, all purchases are final and non-refundable.

6. Virtual Items and Virtual Currency

The Service may include virtual items, virtual currency, rewards, boosters, hints, lives, energy, or other digital content.

Virtual items and virtual currency are licensed to you, not sold. They do not represent real money, have no real-world monetary value, and cannot be exchanged, transferred, sold, gifted, redeemed, or converted into cash or any other value outside the Service.

We may manage, modify, replace, remove, limit, or discontinue virtual items, virtual currency, rewards, prices, balances, or related features at any time, where permitted by law.

You are not entitled to compensation for changes to virtual items, virtual currency, rewards, game balance, features, or content, except where required by applicable law.

7. Advertising

The Service may display advertising.

Advertisements may be provided by third-party advertising networks, advertising mediation platforms, including CAS.AI where applicable, and other advertising partners.

Advertising may be personalized or non-personalized depending on your location, consent choices, platform settings, device settings, and applicable law.

We are not responsible for third-party advertisements, external websites, products, services, claims, or content displayed or linked through advertisements.

Your interactions with third-party advertisements or services are solely between you and the relevant third party.

8. Third-Party Services

The Service may include, integrate, or rely on third-party services, including app stores, payment providers, analytics tools, crash reporting tools, attribution providers, advertising networks, advertising mediation platforms, cloud services, platform services, and other service providers.

Your use of third-party services may be subject to separate terms and privacy policies provided by those third parties.

We are not responsible for the availability, security, accuracy, policies, content, or practices of third-party services.

9. Acceptable Use

You agree not to:

• use the Service for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose;
• copy, modify, distribute, sell, rent, lease, license, or exploit any part of the Service;
• reverse engineer, decompile, disassemble, or attempt to extract source code from the Service;
• use cheats, bots, automation, hacks, exploits, unauthorized software, or other methods to interfere with the Service;

• interfere with, disrupt, damage, overload, or compromise the Service or related systems;
• attempt to gain unauthorized access to any account, system, network, data, or part of the Service;

• use the Service in a way that violates applicable laws, platform rules, or these Terms.

We may take action if we believe you have violated these Terms, including limiting access, removing content or progress, suspending features, or terminating your access to the Service.

10. Updates, Changes, and Availability

We may update, modify, balance, improve, suspend, or discontinue any part of the Service at any time.

This may include changes to gameplay, levels, rewards, events, prices, virtual items, virtual currency, advertising, features, availability, and supported platforms.

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or operating system.

We may stop supporting or operating any game, feature, or service where reasonably necessary, including for technical, business, legal, security, or operational reasons.

11. User Accounts

Some parts of the Service may allow or require user accounts, platform accounts, or third-party login services.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

If you believe your account has been compromised, you should contact the relevant platform provider and, where applicable, contact us.

We may suspend or terminate access to accounts or related features if we believe these Terms have been violated.

If our games do not currently support user accounts, this section applies only if such features are introduced in the future.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable law, Game Shelter disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and error-free operation.

We do not guarantee that the Service will meet your expectations, be uninterrupted, secure, or free from errors, bugs, viruses, or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Game Shelter shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, service interruption, device issues, or loss of virtual items or virtual currency arising out of or related to your use of the Service.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid to Game Shelter through the Service during the twelve months before the event giving rise to the claim, or EUR 50, whichever is greater.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Game Shelter from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to:

• your use or misuse of the Service;
• your violation of these Terms;
• your violation of applicable laws or platform rules;
• your infringement of any rights of another person or entity.

16. Termination

We may suspend, limit, or terminate your access to the Service at any time if we believe you have violated these Terms, created risk or legal exposure for us, or used the Service in a harmful, fraudulent, abusive, or unlawful manner.

You may stop using the Service at any time.

After termination, your right to use the Service will immediately stop, but sections that by their nature should survive termination will continue to apply, including intellectual property, virtual items, disclaimers, limitation of liability, and applicable legal provisions.

17. Governing Law

These Terms shall be governed by the laws of the Czech Republic, unless otherwise required by applicable consumer protection laws.

If you are a consumer, you may also benefit from mandatory protections provided by the laws of your country of residence.

18. Changes to These Terms

We may update these Terms from time to time.

When we update these Terms, we will post the updated version on this page and update the "Effective date" at the top.

Where required by law, we may provide additional notice, such as an in-app notice, website notice, or other reasonable method.

Your continued use of the Service after the updated Terms become effective means that you accept the updated Terms.
